§ 1 Scope of the Terms and Conditions

1 The following terms and conditions apply to all our contracts and orders in the version valid at the time the contract is concluded.
2. general terms and conditions of the buyer are contradicted, they do not become part of the contract.

§ 2 Conclusion of contract

1. your contract is concluded when we accept your order.
2. easyglue accepts the contract upon delivery of the goods or provision of the service.
3. we will immediately confirm receipt of electronic orders electronically - however, this does not constitute acceptance of the contract.

§ 3 Cancellation policy

The following right of withdrawal does not apply if you are ordering for the purpose of your own commercial or independent professional activity.
1. right of withdrawal

You can revoke your contractual declaration within 14 days without giving reasons in writing (e.g. letter, fax, e-mail) or, if the goods are delivered to you before the deadline, by returning the goods. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods not before receipt of the first partial delivery), but in the case of the provision of services not before conclusion of the contract and also not before fulfillment of our information obligations under Article 246, § 1 (1) and (2) EGBGB and our obligations under § 312 e (1) sentence 1 BGB in conjunction with Article 246, § 3 EGBGB.

The timely dispatch of the revocation or the goods is sufficient to comply with the revocation period. The revocation is to be sent to:

However, the right of withdrawal does not apply in the cases of § 312 d para. 4 BGB.
2. consequences of revocation

In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) surrendered. If you are unable to return the service received in whole or in part or only in a deteriorated condition, you may have to compensate us for the value. In the case of services, this may mean that you must nevertheless fulfill the contractual payment obligations for the period up to the revocation.

This does not apply to the surrender of goods if the deterioration of the goods is exclusively due to their inspection, as would have been possible for you in a store, for example. In addition, you can avoid the obligation to pay compensation for any deterioration caused by the intended use of the item by not using the item as if it were your property and by refraining from doing anything that could impair its value. Items that can be sent by parcel post are to be returned at our risk. You must bear the costs of returning the goods if the goods delivered correspond to those ordered and if the price of the goods to be returned does not exceed 40 euros or, if the price of the goods is higher, if you have not yet paid the consideration or a contractually agreed part payment at the time of revocation. Otherwise the return shipment is free of charge for you. Items that cannot be sent by parcel post will be collected from you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of revocation or the goods, for us with their receipt.
3. special notes

Your right of withdrawal expires prematurely if the contract has been completely fulfilled by both parties at your express request before you have exercised your right of withdrawal.

§ 4 Inspection obligations of the buyer

1. the illustrations, drawings and technical data shown on our website are subject to ongoing changes by the product manufacturers. Product photos do not necessarily show the scope of delivery, but merely symbolize the object of purchase and may differ from the delivered goods.
2. you are obliged to check the goods you receive carefully and precisely to ensure that the data and values specified correspond to your order. You must carefully check the functionality of the ordered goods before using them and ensure that the delivered items are suitable for your intended use.
3. for merchants, the obligations under commercial law to inspect and give notice of defects shall also apply.

§ 5 Availability of goods

If the ordered goods are not available or the service cannot be provided or an equivalent product cannot be delivered, you will be refunded the purchase price including shipping costs.

§ 6 Shipping costs

A flat-rate delivery and shipping fee is charged for shipping. These costs are listed separately in the easyglue store.

§ 7 Prices

The prices are net, plus the statutory value added tax. Otherwise, the list prices at the time of order acceptance shall apply.

§ 8 Warranty, statute of limitations

1. the warranty period is one year in single-shift operation or 3 months in multi-shift operation, but at most up to a total operating time of 1000 hours starting from the date of our delivery. Wear parts are excluded. The purchaser must notify us immediately in writing of any defects and send us the defective goods free of charge. The customer's right to assert claims arising from defects shall in all cases expire 6 months from the date of the timely complaint, but at the earliest upon expiry of the warranty period. Any warranty claim of the customer shall lapse if he himself or a third party carries out modifications or repairs to goods delivered or repaired by us without our written consent.
2. further claims of the customer, in particular a claim for compensation for damage that has not occurred to the delivery item itself, are excluded.

§ 9 Returns and refunds

Purchased goods that are as described will not be taken back or refunded by us.

§ 10 Place of jurisdiction, choice of law

1. place of jurisdiction for both parties is Augsburg.
2. the law of the Federal Republic of Germany shall apply; the application of the UN Convention on Contracts for the International Sale of Goods is excluded.

Note on data protection:

1. personal data is information that indicates your identity: Name, address, postal address, delivery address, telephone number and e-mail address.
We store your personal data and the data of the ordered goods only insofar as this is necessary for the processing and handling of your order. We do not pass on your personal data to third parties.

2. when you visit our website, information about the access (date, time, page viewed, shopping cart content) may be stored on our server. This data is not personal data, but is anonymized. They are analyzed by us exclusively for statistical purposes.

3. cookies are used on certain pages. Most browsers are set to accept cookies automatically. However, you can deactivate the storage of cookies or set your browser so that it notifies you as soon as cookies are sent.

4. you have a right to free information about your stored data and, if necessary, a right to correction, blocking or deletion of this data.
